What is the Statute of Limitations to File a Medical Malpractice Lawsuit?

Each state has its own rules regarding the statute of limitations to file medical malpractice claims. Both Florida and Georgia mandate that a medical malpractice suit be filed within two years of the date of injury, except in cases in which the injury is not discovered immediately, in which case the clock on the 2-year period may start when the injury is discovered. In Minnesota, the claim must be filed within four years of the date that the injury is discovered.
