Frequently Asked Questions About Car Accidents in St. Petersburg

How can an auto accident lawyer help you? Is it necessary?

Getting an auto accident lawyer to handle your accident claim is highly recommended if you want to try to maximize the financial compensation you receive from the responsible party’s insurance company. Experienced car accident lawyers concentrate their legal practice on effectively presenting the facts of your case and negotiating settlements that may cover every damage for which you deserve to be compensated: lost wages, medical bills, physical and psychological pain and suffering, future medical expenses, therapy, rehabilitation, and property damages.

How do I find the right car accident lawyer?

When searching for the right car accident lawyer, three of the most valuable features to look for are experience, focus, and resources. A St. Petersburg firm like The Ruth Law Team has extensive experience representing car accident injury victims throughout the U.S. We focus our entire practice on helping people who were hurt by others’ negligence and irresponsible behavior. We also have the financial resources to stand up to large companies that might overwhelm another law firm.

How much do we charge for auto accident cases?

We receive no pay unless our client gets paid. In keeping with the standard practice across the nation, we retain an agreed-upon percentage of the settlement or judgment we obtain on our client’s behalf. We pay all the advance expenses related to investigating the case and collecting all the evidence needed to support our client’s claim until the case is resolved. We are happy to discuss our fee practices at any time.

How long does the whole process take?

Some cases could be successfully resolved in just a few months. However, many clients suffer serious injuries requiring long periods of recuperation and continued medical treatment. We want to establish the full scope of the client's injuries so any settlement can include all the recoverable damages.

How are auto accident settlements determined?

The settlement amount generally may the injury victim’s lost wages and any loss of earning capacity, expenses for medical treatment, rehabilitation, and property damage. However, the value of the victim’s loss of use of a body part or an organ, or their physical and mental suffering, is more difficult to put a price on. Settlements also may vary based on the insurance coverage available, which is why it is so important to carry both BI and UM insurance. As our client’s advocates, The Ruth Law Team works continuously to obtain settlements fairly reflecting the gravity of every client’s pain and suffering.

How long after an accident can you file a claim?

There is no reason to delay. Contacting experienced accident lawyers immediately enables them to begin working to get you fair compensation. If notified the same day the accident  occurred, your lawyer may be able to have an investigator visit the accident scene when the evidence of the crash remains in place. Skid marks, the place where the debris came to rest, and information about possible witnesses could be collected. In Florida, the personal injury protection (PIP) law requires a person seeking PIP coverage to seek medical attention within 14 days from the accident date. While we recommend you do not wait to bring your damage claim, the law allows 2 years from the date of the accident to file suit for property damages.

How car total loss is determined?

The methods used to declare a car a total loss vary from state to state. Some states use the Total Loss Formula (TLF) in which the cost of repairing the car plus the car’s salvage value are added together to see if that figure exceeds the actual cash value of the car. If it does, then the car will be a total loss. Other states use the Total Loss Threshold (TLT) method to total a car. These states legally require insurers to use a particular percentage of a car’s actual cash value as the threshold to declare the car a total loss. For example, Florida sets the total loss threshold at 80%. If the cost of repairing the car is higher than 80% of the car’s market value, the car is totaled. If the repair costs add up to only 78% of the car’s value, then the car will be repaired.

What do I do if the insurance company is not offering me enough for my car?

If you are unsatisfied with the insurance company’s proposed payout for your totaled car, you can counter their offer with what you believe to be the actual market value of your car. You should send copies of receipts for any upgrades or improvements you added, photos of the car, and include references to other comparable vehicles with published values higher than the insurer’s offer. If you have questions, contact a car accident lawyer.

How long does it take for insurance to pay a car off after an accident?

Insurance payouts for damage to a car after an accident generally take between 30 to 45 days. However, some states mandate that insurers resolve auto property damage claims within a set period. In Florida, insurance companies are generally required to pay the claim no later than 30 days after receiving the claim information. Visit your state’s insurance regulator’s website to see what rule applies where you live.
