This was a hard-fought battle, and we didn’t do it alone. We, along with our co-counsel previously mentioned, went up against big tobacco company RJ Reynolds, and we won.
Early last year, Attorney James Clark opened the case of Kelley v. R.J. Reynolds by telling the jury about the evidence they would hear during the trial, once curated and hid by executives working for RJ Reynolds.
“Their documents, for half a century, were marked confidential and secret and were never available to the public and the public domain. Basically the story is a story of lies, deceit, misinformation, disinformation, withholding of information, and as a result, millions of Americans who became addicted to nicotine and cigarettes, and millions of Americans died as a result of smoking related diseases.”
Jurors agreed with the plaintiff that Mrs. Kelley died of lung cancer, which was caused by years of addiction to nicotine. Big tobacco hid the dangers of smoking for years and years, encouraging people, including our client, to continue buying their dangerous products. Ultimately, the jury awarded the family $2,000,000 in compensatory damages. The punitive damages portion of the case was settled between RJ Reynolds and the family.
