Friday, after a two week trial, a West Virgina jury awarded Jo Huskey 3.27 million dollars against Johnson & Johnson.
This claim is one of thousands filed as part of a multi-district litigation in West Virginia against Johnson & Johnson.
In the trial, Huskey claimed that Ethicon, a subsidiary of Johnson & Johnson, failed to warn doctors and consumers of the risks of the device. The jury found that Ethicon was negligent in marketing and selling the Gynecare TVT Obturator. Huskey had the device implanted when she was 52 to treat her stress urinary incontinence.
This is the second consecutive verdict for plaintiffs. In April a jury in Dallas awarded $1.1 million to Linda Batiste for damages over the defective design of her transvaginal obturator.
